Yuga Labs Settles Lawsuit Over Bored Ape Lookalike NFTs

Yuga Labs settled litigation with artists accused of producing NFTs that replicated Bored Ape Yacht Club designs, resolving trademark and copyright claims.

Yuga Labs reached a private settlement this week with a group of artists accused of copying the company’s Bored Ape Yacht Club (BAYC) designs, ending litigation over alleged trademark and copyright infringement.

The dispute began when Yuga Labs filed suit, alleging that the artists produced and sold NFTs and related merchandise that closely replicated BAYC imagery and branding. The company sought injunctive relief to block further sales and damages for what it described as unauthorized use of its marks. The artists defended their works as independent creations and raised free-expression and fair-use arguments.

The parties did not disclose the terms of the settlement. Court records show the case was active in U.S. courts before the agreement, and filings included legal briefing on how trademark and copyright law apply to digital art sold as nonfungible tokens.

The litigation involved questions about whether trademark protection can extend to digital likenesses, how far creators can go when producing works inspired by existing NFT collections, and what remedies are available when alleged derivative works appear on secondary markets.

Yuga Labs has pursued other legal actions since launching BAYC in 2021, asserting trademark rights over ape imagery and related merchandise as the collection expanded into brand partnerships and licensing. The company identified control over derivative uses as part of its enforcement strategy.

Lawyers and participants in the NFT market followed the case because it raised unsettled legal issues for digital collectibles. The settlement resolves this dispute without a court ruling that would have established a binding legal precedent.

Courts, regulators and market participants continue to consider how traditional intellectual-property doctrines apply to blockchain-based art and user-generated derivatives. Legal practitioners note that private settlements resolve individual matters but leave broader legal questions unresolved.
