Kalshi court deadlines and Sorsby NCAA injunction set for June

In Connecticut, defendants must file a motion to dismiss the Commodity Futures Trading Commission’s lawsuit by June 3. Kalshi’s response in that case is due June 24. The CFTC has argued that federal law preempts Connecticut’s restrictions on prediction markets and asked the court to reject the state’s statutory regime.

In the Sixth Circuit appeal over Ohio’s enforcement actions, the state’s response brief is due June 4. Kalshi filed its opening brief on May 5 and the CFTC filed an amicus brief supporting Kalshi on May 12. An April Sixth Circuit ruling denied Kalshi an injunction pending appeal, leaving Ohio’s enforcement actions in place as the appeal proceeds.

In Wisconsin, Kalshi must respond by June 5 to an amended complaint from the Ho-Chunk Nation. A federal judge allowed the tribe’s Indian Gaming Regulatory Act claims to proceed while dismissing separate RICO and Lanham Act allegations. The tribe moved to amend its complaint and Kalshi sought interlocutory review of parts of the ruling.

Other potential developments include Minnesota, where both the CFTC and Kalshi sued after the state enacted laws banning prediction markets; New York, where Kalshi has asked to consolidate multiple suits and the state accused the company of “gamesmanship”; and Washington, where the Ninth Circuit denied a stay after a federal court remanded a case to state court, potentially prompting state-level filings.

Pending filings list the legal questions before the courts: whether federal law preempts state rules on prediction markets, the scope of the CFTC’s authority over those markets, and whether judges will issue stays that affect enforcement while appeals continue.

Sorsby, formerly at Indiana and now at Texas Tech, is scheduled to seek a temporary injunction Monday. Court records say he placed bets on Indiana football games in 2022 and that he has acknowledged a gambling addiction and completed treatment. NCAA filings argue Sorsby knew the association’s wagering rules when the bets were placed and state that reinstating him would have “broad-ranging and destabilizing ramifications.” A court decision in Sorsby’s favor would permit him to return to play in the 2026 season.

On legislation, several gambling-related bills await gubernatorial action. In Louisiana, measures labeled HB 513, SB 325 and SB 339 addressing name-image-and-likeness agreements, protections against abusive bettors and background checks await Gov. Jeff Landry. Illinois lawmakers sent SB 2749 to Gov. J.B. Pritzker; the bill would expand programs for gambling disorder prevention, treatment and recovery. In Colorado, SB 131, a responsible-gambling bill, and SB 163, a regulatory oversight measure, reached Gov. Jared Polis, who has 30 days after the session closed to act.

Key dates this week include the June 3 motion deadline in Connecticut, Ohio’s June 4 response deadline in the Sixth Circuit, Kalshi’s June 5 filing deadline in Wisconsin, Kalshi’s June 24 response in Connecticut, and Sorsby’s court appearance on Monday. Court filings and governors’ decisions remain pending.
